Assistant Attorney General I-III | Administrative Law
The Texas Attorney General's Office is a dynamic state agency providing legal representation in diverse areas of law. They are seeking Assistant Attorneys General to represent state agencies in various legal matters, including enforcement and administrative appeals, while managing their own litigation dockets.
Responsibilities
Represents state agencies in state and federal district and appellate courts in matters involving judicial review of agency orders, enforcement proceedings, actions challenging agency rules and statutes, and non-party subpoenas; may represent the Office of the Attorney General and state agencies in state district and appellate courts in open records litigation; may serve as general counsel to state agencies
Drafts pleadings, motions, briefs, memoranda and discovery; participates in trial and appellate advocacy
Analyzes entry-level factual and legal issues
Performs legal research
Coordinates, plans, and monitors legal activities
Provides legal advice, counsel, and assistance
Independently manages a diverse litigation docket with supervision
Represents state agencies in administrative enforcement proceedings before the State Office of Administrative Hearings
Performs related work as assigned
Maintains relevant knowledge necessary to perform essential job functions
Attends work regularly in compliance with agreed-upon work schedule
Ensures security and confidentiality of sensitive and/or protected information
Complies with all agency policies and procedures, including those pertaining to ethics and integrity
Analyzes routine factual and legal issues
Independently manages a diverse litigation docket with moderate supervision
Analyzes moderately complex factual and legal issues
Independently manages a diverse litigation docket with general supervision
Qualification
Required
Experience in administrative law, or willingness to learn
Willingness to represent state agencies in state and federal district and appellate courts
Ability to handle enforcement matters, including suits to enjoin unlicensed activity and for civil penalties
Ability to handle defensive matters, including administrative appeals, rule challenges, ultra vires claims, and defending the OAG in cases arising under the Public Information Act
Ability to assist state agencies in responding to non-party subpoenas
Ability to provide general counsel assistance to state agencies
Ability to draft pleadings, motions, briefs, memoranda and discovery
Ability to participate in trial and appellate advocacy
Ability to analyze entry-level factual and legal issues
Ability to perform legal research
Ability to coordinate, plan, and monitor legal activities
Ability to provide legal advice, counsel, and assistance
Ability to independently manage a diverse litigation docket with supervision
Ability to represent state agencies in administrative enforcement proceedings before the State Office of Administrative Hearings
